Revision to the NHS Terms and Conditions for the Supply of Goods and the Provision of Services – Termination for Convenience clause
On March 12th, Department of Health & Social Care (DHSC) published a revision to the NHS Standard Terms and Conditions of contract with suppliers which now includes a Termination for Convenience clause (in Schedule 1).
In summary, addition of the clause allows Trusts to ‘deliver savings and support the Future Operating Model (FOM) whilst ensuring they are not inadvertently disadvantaged from accessing savings via the FOM because of committing to a local or regional arrangement direct with a supplier’ by providing the ability to terminate such a contract at a Trusts’ convenience.
DHSC strongly encourages Trusts to ‘consider and utilise this clause where considered appropriate’.
